A Right isn't A Gift

Indonesia, a nation possesses wealt every inch of its land and water. The rice, vegetables and fruits that grow are an abundant source of nourishments. The wide, green forests provide timber and other useful plants. Rivers, lakes, seas and oceans provide fish and mineral that hasn’t been fulfully utilized/managed.

Indonesia, The wealthy Paradise that is inhabited by millions of poor and marginalized people. The country has failed to carry out its duty. Which is to fulfill E.S.C rights of its citizens.

What is E.S.C Rights ??????..... ESC Rights is abbreviation from Economic, Social and Cultural Rights. And there are five categories of those kind of Rights, those are to say : the right to Health (care), the right to education, the right to housing, the right to property and the right to employement.

The forms of violation of ESC in this country are relatively, the problems of neglect, in these matters where the State does nothing (to fulfill them). The Little example would be collapsing elementary school buildings. The right to housing is relatively easier because there is an element of forced eviction. And the right to healt has never been enjoyed by the poor because the expensive cost of health care is out of their reach.

How do the people fight for their ESC rights.?????. The simple ways are monitorring of Provincial Budget Allocation (APBD), advocate the policy it self, we could contribute bills drafts of laws, and we could also be involved the spending budget.

Why do the people Must fight for their ESC rights ...????. the answer from that question is because “That Economic, Social, Cultural and other rights are guaranteed by the constitution.” Therefore we HAVE TO FIGHT for IT.

All of my Friends : “A gift is different from A Right”, what si called a right is fought for everywhere, we can’t wait for something from the sky........

Pasal 28C

(1) Setiap orang berhak mengembangkan diri melalui pemenuhan kebutuhan dasarnya, berhak mendapat pendidikan dan memperoleh manfaat dari ilmu pengetahuan dan teknologi, seni dan budaya, demi meningkatkan kualitas hidupnya dan demi kesejahteraan umat manusia. **)


PENDIDIKAN DAN KEBUDAYAAN****)

Pasal 31

(1) Setiap warga negara berhak mendapat pendidikan. ****)
(2) Setiap warga negara wajib mengikuti pendidikan dasar dan pemerintah wajib membiayainya. ****)

(4) Negara memprioritaskan anggaran pendidikan sekurang-kurangnya dua puluh persen dari anggaran pendapatan dan belanja negara serta dari anggaran pendapatan dan belanja daerah untuk memenuhi kebutuhan penyelenggaraan pendidikan nasional. ****)
(5) Pemerintah memajukan ilmu pengetahuan dan teknologi dengan menjunjung tinggi nilai-nilai agama dan persatuan bangsa untuk kemajuan peradaban serta kesejahteraan umat manusia. ****)



PEREKONOMIAN NASIONAL DAN KESEJAHTERAAN SOSIAL****)

Pasal 34

(1) Fakir miskin dan anak-anak yang terlantar dipelihara oleh negara. ****)
(2) Negara mengembangkan sistem jaminan sosial bagi seluruh rakyat dan memberdayakan masyarakat yang lemah dan tidak mampu sesuai dengan martabat kemanusiaan. ****)
(3) Negara bertanggung jawab atas penyediaan fasilitas pelayanan kesehatan dan fasilitas pelayanan umum yang layak. ****)
